Welcome to Puspawijaya Property Agency. We are committed to providing transparent, professional, and reliable property agency services. This Refund Policy explains the terms regarding refunds for services and transactions facilitated through our platform.

We kindly ask you to read this policy carefully. In the property industry, transactions involve multiple parties (including sellers, buyers, developers, and banks), and refund terms are highly dependent on the binding agreements between those parties.

1. Consulting and Agency Services

Puspawijaya offers professional services for marketing, consultation, and facilitation of property sales, purchases, and rentals.

  • Marketing Fees / Listing Fees (If Applicable): Any fees charged upfront to list and market your property (e.g., for advertising, professional photos) are non-refundable once the marketing service is active or has been performed.

  • Consultation Fees (If Applicable): Fees for scheduled and completed property consultation sessions are non-refundable.

  • Agency Commission (Success Fee): The commission paid to Puspawijaya for a successful transaction (sale, purchase, or lease) is non-refundable once the transaction is legally concluded (e.g., after the signing of the Deed of Sale and Purchase (AJB), Lease Agreement, or unit handover).

2. Property Transaction Funds (Booking Fee & Down Payment)

Puspawijaya acts as an intermediary (agent) facilitating transactions between a Buyer and a Seller/Developer. Funds related to the property purchase, such as a Booking Fee or Down Payment (DP), are strictly governed by a separate agreement.

Important: The refund of these funds is NOT determined by Puspawijaya, but by the terms agreed upon in the Binding Sale and Purchase Agreement (PPJB) or the reservation form between you and the Seller/Developer.

Common Scenarios:

  • Cancellation by Buyer: If the Buyer unilaterally cancels the transaction (e.g., changes their mind) after paying the Booking Fee or DP, these funds are generally considered forfeited or non-refundable as per the initial agreement with the Seller/Developer.

  • Mortgage (KPR/KPA) Application Rejected: Many developers (especially for new properties) offer a policy to refund the Booking Fee if the Buyer's mortgage (KPR/KPA) application is rejected by the bank.

    • This policy varies. Some developers may refund the full amount, while others may refund it after deducting administrative fees.

    • Puspawijaya will assist in facilitating this claim process according to the terms and conditions set by the Developer.

  • Cancellation by Seller/Developer: If the Seller/Developer unilaterally cancels the transaction, the Buyer is generally entitled to a full (100%) refund of the Booking Fee or DP that has been paid.

3. Puspawijaya's Role in the Refund Process

As your property agent, our role is to:

  1. Provide Upfront Transparency: Ensure you understand all terms and conditions related to payments and cancellations from the Seller/Developer before you make a payment.

  2. Act as Facilitator: If you are entitled to a refund from the Seller/Developer (e.g., due to a rejected mortgage application), we will help facilitate the submission process, submit the required documents, and coordinate with the relevant parties.

  3. Not a Guarantor: Puspawijaya cannot guarantee or expedite refunds that are the right and responsibility of the Buyer and Seller/Developer. The refund processing time depends entirely on the Seller/Developer's policies.

4. Refund Claim Process (from Developer/Seller)

If you believe you are entitled to a refund from a Developer or Seller according to your agreement (PPJB), the following steps can be taken:

  1. Contact Our Agent: Immediately inform the Puspawijaya agent who is handling your case.

  2. Prepare Documents: Prepare all relevant documents, such as:

    • Proof of payment (Booking Fee/DP receipts).

    • Unit Reservation Form or draft of PPJB.

    • Official mortgage rejection letter from the bank (if relevant).

    • Identity card (KTP) and Tax ID (NPWP).

  3. Verification Process: We will forward your application to the Seller/Developer. They will conduct an internal verification.

  4. Process Updates: We will keep you informed about the status of your refund application based on the information we receive from the Seller/Developer.
